Gun Charges Dropped
A Queens man was arrested on gun possession and marijuana charges after allegedly being observed making a sale of marijuana. Officers conducted a warrantless search of the man’s belongings, outside of his view and outside of view of any cameras. Officers alleged they discovered a gun in the man’s bag. After conducting pre-trial Dunaway/Mapp hearings and submitting briefs of legal arguments, we were able to highlight serious constitutional problems with the warrantless search conducted by police officers in this case and ultimately were successful at having the gun charges dismissed. The client pleaded guilty to a lesser marijuana possession charge and was sentenced to a fine and probation.
